Security Act

Of particular relevance to government contractors, the Homeland Security Act includes a subtitle called the Support Anti-Terrorism by Fostering Effective Technologies Act of 2002 (SAFETY Act). This Act contains two key provisions relating to government contracting which:

1) limits civil remedies and jurisdiction for product liability claims against contractors that have provided the government with a "qualified anti-terrorism technology"; and

2) limits liability for contractors by prohibiting civil recovery beyond a contractor's reasonable insurance coverage.
